Section 7 ESA Consultation

Myers Construction Solutions Chief Biologist George Visger has prepared numerous biological assessments under Section 7 of the Endangered Species Act, which requires evaluation to determine whether a project is likely to adversely impact proposed species, listed species, or designated critical and essential habitat. In addition, Section 7 consultation requires addressing whether the project may jeopardize the continued existence of species that are proposed for listing or adversely modify proposed critical habitat. Myers Construction Solutions provides ESA consultations with USFWS, CDFG, USACE and NOAA Fisheries Service to ensure your project maintains compliance.

Section 10 Permits and Habitat Conservation Plans (HCP)

Section 10(a)(1)(B) permits are issued to non-Federal entities for any other activities involving take of listed species otherwise prohibited by section 9 of the Endangered Species Act. Section 10(a)2(A) requires applicants for a section 10(a)1(B) incidental take permit to submit a "conservation plan" - referred to as a Habitat Conservation Plan or HCP.

Biological Resource Assessment, Impact Analysis and Mitigation Development

Myers Construction Solutions has consulted with the Regional Water Quality Control Board, U.S. Army Corps of Engineers, U.S. Fish and Wildlife Service, California Department of Fish and Game and the U.S. Forest Service in the preparation of mitigation, vegetation monitoring and invasive species management plans for impacts to sensitive resources. We have a thorough understanding of habitat requirements of special status species such as San Joaquin kit fox, Conservancy fairy shrimp, California red-legged frog, Swainson’s hawk and vernal pool vegetation such as the endangered Maroon spot Calico flower, which we incorporate into our plans to facilitate protection of resources and maintain project compliance.

Fishery Endangered Species Act Consultation

The Sacramento/San Joaquin delta is host to a number of threatened and endangered fish species such as Delta smelt, green sturgeon, and several species of salmonids, all of which rely upon the delta for at least a portion of their life cycle. Many projects in northern California have the potential to adversely affect these species and their habitat, requiring consultation with NOAA Fisheries and USFWS to determine and minimize the potential impacts. Myers Construction Solutions has extensive experience in conducting informal and formal consultation with these agencies, including the preparation of biological assessments, evaluations, negative declarations, avoidance measures and mitigation plans.
